Terms and conditions

General information

To purchase a service, you must accept these General Terms and Conditions of Contract and Sale without reservation. Ignorance of these terms does not exempt any user from complying with them.

Bookings can be made through the Enigmik website, enigmik.com, or by calling +34 93 280 74 12. These terms and conditions of contract and sale apply in all cases.

Although minors may participate in the service, the person contracting it must be an adult. Enigmik reserves the right to ask users for documents proving their identity where there is doubt about the accuracy of their details, and may refuse service if the user does not comply.

Users are hereby informed that the controller will process their data under the terms described in our privacy policy. Users must provide true and accurate data and are solely responsible for any consequences arising from inaccurate or false information.

Security

In accordance with the Spanish Law on Information Society Services and Electronic Commerce (LSSI-CE), Enigmik has a duty to retain electronic communications traffic data, essential for identifying their origin when the service was first provided, for a maximum of twelve months. This retention obligation does not affect the secrecy of communications.

Enigmik receives users’ IP addresses because browsers send them whenever they request access to our pages. For security reasons, these addresses are stored in our log files and made available to the competent authorities as provided by law, where necessary to identify the person or persons responsible for unlawful acts. The logs record the IP address and the date and time of each request to our server. They are also used to analyse trends, administer the system and collect statistical information.

Enigmik manages bookings and sales through Escape Room Director and uses Redsys as its payment gateway. Data exchanged between users and Enigmik are encrypted through a gateway with its financial institution using SSL (Secure Sockets Layer). Credit card details are neither stored on nor transmitted to our servers: this process takes place entirely on the financial institution’s website, helping to protect the information from intruders.

Invoicing

Pursuant to Article 17 of the Invoicing Obligations Regulation, approved by Royal Decree 1619/2012 of 30 November, Enigmik Team Work, S.L., tax identification number (NIF) B66708165, at C/Rosselló 508, bajos, 08026 Barcelona, may send you invoices and other documents electronically.

As stated in that Royal Decree, electronically transmitted documents have the same legal validity as printed documents, provided they are kept in the format in which they were electronically generated.

The user agrees to Enigmik’s use of PDF and confirms that they have the necessary computer equipment. Invoices will be sent to the email address provided as mandatory information during registration.

By accepting these terms, the parties agree that the documents will not be sent on paper unless a specific request is made to Enigmik.

Prices and bookings

The price of the service depends on the number of participants and the time selected. Enigmik reserves the right to change its price list and offers without prior notice. Orders are accepted subject to correction of the price if typographical or other errors are found.

Published prices include applicable taxes unless expressly stated otherwise, as with La Piràmide, advertised from €35 per person plus VAT.

Users may apply no more than one discount code per group and must do so before confirming the booking. Discount codes will not be accepted afterwards. They may be subject to their own conditions and validity periods, separate from these terms.

A service can be booked from up to three (3) months in advance until one (1) hour before it begins. A booking is only considered confirmed once the online process has been completed, either with the applicable payment or by redeeming a valid gift voucher. Users will receive an automatic confirmation email setting out the booking details and a summary of some service conditions. If the email is not received or contains an error, please contact Enigmik immediately by phone or email and explain the issue.

Payment and cancellations

As a general rule, a €40 deposit is payable when confirming an online booking. No additional payment is required when a valid gift voucher covers the full amount.

Users can pay by credit or debit card. When card details are entered on the website, they are encrypted automatically and the secure payment gateway connects directly to the bank to process payment securely.

The remaining balance can be paid by card or in cash on the day of the booking.

Enigmik reserves the right to cancel a booking at any time if it detects an attempt at fraud by the user.

Once a booking has been made, the user may cancel it at least seventy-two (72) hours before the service begins. A change of date can be requested at no charge at least seventy-two (72) hours beforehand. If requested less than seventy-two (72) hours but at least twenty-four (24) hours beforehand, a change of date costs €20. Changes of date are not accepted less than twenty-four (24) hours beforehand. A cancellation or change may be requested by phone or by emailing info@enigmik.com.

Cancelling a booking at least seventy-two (72) hours in advance will result in a gift voucher for the amount paid, valid for one year. Payments are not refunded.

If the booking is cancelled less than seventy-two (72) hours in advance, if the user does not attend, or if the user arrives more than fifteen (15) minutes after the scheduled start, the booking and the amount paid will be forfeited, with no gift voucher or refund. If a user is more than fifteen (15) minutes late, Enigmik may, at its discretion, provide the service if doing so does not prejudice services booked by others.

Accepted booking changes are subject to the deadlines and charges set out above. If a change increases the price, the difference can be paid with the same card or by another method agreed by the parties. If the price decreases, the difference will be refunded.

If Enigmik cannot provide the service for technical reasons or for any other reason directly attributable to it, the user may choose a new date or request a refund of the price. Enigmik will contact affected users without undue delay.

Gift vouchers cannot be cancelled. However, if a voucher cannot be used within its validity period due to force majeure, an extension of its expiry date may be offered upon justification.

Conditions of use of the service

The games are designed for groups of 2 to 6 people in Bunker and 2 to 6 people in The Brewery. Each group must include at least one adult responsible for any minors. Because of the games’ complexity, Enigmik does not recommend them for children under 14, who may be unable to solve the puzzles or participate fully. Enigmik may require participants to be adults for particular challenges and will inform users when this applies.

Participants with reduced mobility are advised to consult us beforehand. Although this is a game, some situations may cause stress, fear or surprise. Participants with medical conditions such as cardiovascular disease or epilepsy, or conditions such as claustrophobia or anxiety, should inform Enigmik staff so that incidents can be prevented and risks assessed in advance.

During the service, participants must follow Enigmik staff instructions and comply with these conditions of use at all times. Breaching the rules may result in immediate removal without the right to continue the game or obtain a refund.

Enigmik staff will monitor participants’ actions on screens throughout the game. Sessions are monitored so staff can check compliance with the rules and provide instructions or clues where needed.

Enigmik will refuse entry to users whose condition or behaviour could pose a danger or disrupt the normal running of the game. This includes users under the influence of alcohol, narcotics or psychotropic substances without a medical prescription, those carrying dangerous objects, those acting violently or threateningly, or those with very serious personal hygiene issues. These examples are illustrative and not exhaustive.

Photography and the recording of images, video or audio are not permitted. Using or attempting to use recording devices is a serious breach of the rules and will result in the participants’ immediate removal.

The game ends when it is solved, when the available time expires or when participants leave the play area. The maximum duration is seventy (70) minutes for Bunker and eighty (80) minutes for The Brewery, although Enigmik may extend the duration depending on the circumstances.

The play area is clearly marked.

Specific conditions may be established for particular games in addition to these General Conditions of Use.

Liability

No physical force is required at any stage of the game. The room may contain fragile or delicate items, such as glass, which must be handled carefully and in accordance with Enigmik’s instructions.

Enigmik is not obliged to compensate users or third parties for personal, property or equipment damage caused during the service where that damage results from the negligent or intentional conduct of a user. Enigmik has public liability insurance to address possible claims arising from abnormal operation of the game.

Applicable law and jurisdiction

These general terms of sale and any dispute concerning the contract are governed by Spanish law. Any dispute arising from the contract will be submitted exclusively to the Spanish courts.

Where the buyer resides outside Spain or the purchase is made by a company, both parties expressly waive any other jurisdiction and submit to the courts of the city of Barcelona, Spain.

These terms take account of the Electronic Commerce Law, the Retail Trade Law and the Royal Decree on telephone and electronic contracting, among other related provisions.
